CHECKUPS PROMOTION OFFICIAL RULES

No purchase necessary to enter or win. Purchase does not increase
chances of winning. Void where prohibited by law.

1. Promotion Dates: The Checkups Dental Dog Treat Giveaway ("Promotion") begins December 1, 2006 and ends May 31, 2007 ("Contest Promotion Period"). The Promotion is subject to all federal, state and local laws and regulations.
2. Who May Enter: The promotion is open to all residents of the United States and the District of Columbia ("D.C.") who are 18 years of age or older, except for the following persons who are not eligible to enter: (i) Employees, officers and directors of Sugar Creek Pet Products ("Sponsor"); (ii) the respective parent companies, subsidiaries, affiliates, distributors, advertising and promotion agencies of any of the Promotion Parties that are involved in the development or execution of the Promotion; (iii) all other companies associated with this Promotion; and (iv) the immediate family members or households of any of the above. Immediate family members include parents, grandparents, siblings (including step-siblings), children (including adoptive and step-children), grandchildren (including adoptive and step-grandchildren) and spouses.
3. How to Enter the Promotion: To enter the promotion, complete the feedback form in its entirety on www.checkupstreats.com. One entry per household.
   
   Entries that are lost, late, misdirected, or incomplete, for any reason, including hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Sugar Creek Pet Products or elsewhere will not be eligible. Sugar Creek Pet Products, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or who is otherwise in violation of the rules. Sugar Creek Pet Products reserves the right to cancel, terminate, or modify any promotion not capable of completion as planned for any reason, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, or technical failures of any sort. After a feedback form is submitted, Sugar Creek Pet Products may contact entrants by e-mail or telephone to notify winners of the promotion.
4. Prize & Odds of Winning: One entry per week for the month of December 2006 will be randomly selected and notified of winning one free bag of Checkups Dental Dog Treats. One entry per month for the months of January 1, 2007 – May 31, 2007 will be randomly selected and notified of winning one free bag of Checkups Dental Dog Treats. Odds of winning the Promotion depend upon the number of eligible entries received.
5. Additional Rules, Conditions & Restrictions: By participating in this Promotion, entrants agree to abide and be bound by the Official Rules and the decisions of the Sponsor, which are final in all matters relating to this Promotion. If an entrant wins a prize and is found later to be in violation of any of these Official Rules, that entrant will be required to forfeit the prize. All materials submitted for this Promotion become the property of the Sponsor and will not be returned. False, fraudulent entries or attempts to defraud the Sponsor in any manner in connection with this Promotion may be prosecuted to the fullest extent permitted by law.
   
   By entering this Promotion, entrants agree that the Sponsors will not be liable for personal injuries, death, damages, expenses, costs or losses of any kind resulting from or in connection with participation or inability to participate in this Promotion or acceptance, possession or use or inability to use a prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. By accepting a prize, the winner and recipients of the same release the Sponsors from all liability and responsibility with respect to the acceptance, possession or use/misuse of a prize or participation in any prize or prize-related activities (including property loss, damage, personal injury or death). Sponsors will not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not any of the same prove to be invalid), equipment failure, terrorist acts, war, fire, unusually sever weather, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, or any other cause beyond the Sponsors' sole control.
6. Dispute Resolution: Entrants agrees that (1) all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any prizes/offers awarded, will be resolved individually, without resort to any form of class action, and any judicial proceeding will take place in a federal or state court within the State of Missouri; (2) all claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant waives all rights to claim, punitive, incidental and consequential damages, and any other damages (other than for actual out-of-pocket expenses) and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion will be governed by, and construed in accordance with the laws of the State of Missouri, without giving effect to any choice of law and conflict of law rules or provisions (whether of the State of Missouri or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Missouri.
7. Warranty Disclaimer: All prizes are awarded "AS IS," without any warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except for any warranties that may be contained in the manufacturer's warranty. Except as otherwise provided in these Official Rules, Releasees that are not the manufacturers make no warranties, representations or guarantees, expressed or implied, in fact or in law, respecting the performance or use of the prizes claimed; this disclaimer includes, without limitation, the warranties of quality, merchantability, and fitness for particular purpose, and the winner must look solely to the manufacturer for such warranties, if any.
8. By participating in the Promotion, entrants affirm that they have read and accept these rules.
